If one of your parents dies without a will and they own a home, what happens to that home? Can one of your parents leave their share of their home to nieces and nephews if there are children involved?

The decedent's portion of the home passes to the children, but surviving spouse has usufruct (use) of that half.
As long as the children are over the age of twenty-four and not disabled, parents can leave their assets to anyone.
