Legal Question in Wills and Trusts in Louisiana

Renunciation of Heirship

My family has been in an ongoing dispute over property from a great grandmother that never went through succession. I now have interest in this property because my mother (who was a direct heir) passed away three years ago also without a will. I would like to renounce my interest in this property but an not quite sure how to it. A while back, an attorney mentioned filing a ''Renunciation'' with the court. How can I do that? Is this a form I can complete and file myself or should I get an attorney to do it for me?

Re: Renunciation of Heirship

I'm assuming that the attorney meant filing it in Probabe Court since that's where estates are probated and administered. The probate court has standard forms and the clerks are generally good to work with, especially in the smaller counties. Try to find the standard form, if there's not one style it in the general fashion of the standard forms, title it renunciation, and state clearly all the facts involved. Also, I would recommend filing a similar document, with a clear legal description, in the real estate records of the Superior Court since real estate vests immediately in the heirs upon the death of the owner of the property.
