Legal Question in Wills and Trusts in Louisiana

Succession time frames; son-in-law won't provide inheritance

My daughter passed away in May, leaving me a goodly sum of money. My granddaughter is the executrix of the will and is afraid of her father, who refuses to provide me with my inheritance. What recourse do I have?

Was your daughter a Texas resident, or a Louisiana resident. Probate law in Louisiana is quite different from Texas law. If in Texas, did your daughter have a will? And if so, has the will been entered into probate? How do you know that she left you a goodly sum? Is there anything in writing to show that?

The notice I received for you posting shows that this may be a Louisiana or Texas issue. I cannot speak as to Louisiana law, though, if that law controls, I can put you into contact with a fine probate attorney in that state. As for Texas, the best way to seek enforcement of a bequest from a will would be to admit a will into probate, or if no will, to seek a formal administration of the estate. If this has not yet been done, it needs to be -- such takes any question out as to legality and forces quick and proper transfers.
