Re: Settlement

You should contact an attorney. If you are receiving workers compensation benefits, and the vehicle you were run over by was owned by your employer or used for his business, then you may be limited to your compensation claim. You have 1 year from the accident or 1 year from when your last work comp benefit was paid to file a work comp claim. If you were run over by a vehicle not connected to your employer or your job, then you may have a claim against the vehicle owner, driver and their insurance companies. You have 1 year from the accident to sue them. You could have both a work comp claim and a suit against the vehicle owner, driver and insurer, but they are separate claims and just filing for work comp will not affect the 1 year to sue the vehicle. These are all generalities and without knowing more precise details, your rights cannot be determined. Please see an attorney.
