Legal Question in Workers Comp in Louisiana

workmen comp not giving referral

I was injuried at work in 9/07. I was told I had a shoulder separtion, than rotator cuff problem and finally after an MRI a proximal humerus fracture. While I was in a brace, my uninjuried shoulder begin to bother me. I was told this can happen with over use. I was seen by the workmen's comp Dr's for this pain. I was treated with steriod shots and told to go back to full duty. The pain got worst instead of better. I requested a second opinion and told it was no longer a workmen's comp. problem since I had a negative MRI. That I needed to see a neurologist or pain specialist and get the referral from my regular Dr and go under my own insurance. I don't understand why the referral doesn't come from WC Dr and why it should have it swithed to my insurance. I'm on general med now. FMLA was used for my initial injury.

You need to contact an Attorney specializing in WC. If your story is accurate, it sounds like you are getting the shaft.
