Legal Question in Business Law in Maine

Judgement Order

I sued someone and won the civil case

in California. The defendant now lives in

Maine. Do I need to do anything in

Maine to enforce the judgement or can

I just submit the order to his employer

in Maine to garnish his wages?

Re: Judgement Order

The judgment does need to be entered by a Maine Court before Maine has proper jurisdiction to enforce it. That process involves filing it with the right Court and copying it to the Defendant. Once the Judgment has been entered after an objection period, enforcement can begin. In Maine wages cannot be garnished until a seperate Court hearing sets a weekly or monthly that the debtor defaults.

My office commonly does this type of work, sometimes on a contingency for the collection and a flat fee for the domestication. The amount of the judgment will provide a basis for how much of an investment in collection is warranted.

Re: Judgement Order

You need to get your judgment recognized in Maine. The terminology is Sister State Judgment. You should contact a collection lawyer in Maine. Does the debtor have any assets here? Does anyone living here owe the debtor any money?
