Legal Question in Credit and Debt Law in Maine

Theft of services

I am a Mobile Notary that witnessed a refinance mortgage closing (including printing of documents for borrowers & mtge. co.) I was sent confirmation of monies to be paid when docs signed & returned. This was done. Service that hired me now refuses to pay and have done the same to other notaries public in various states. Can charges be brought against them to collect my fees? This money has been owed for 2 closings & numerous attempts to have them pay me have been made, emails, phone calls, etc.

As a civil matter you could file a small claim yourself to collect the fee. As for a criminal matter, you would need to make an appointment with the DA for your county to discuss, and bring all of your paperwork. The DA does not like to get involved in a civil matter, and may decline on that basis, on the other hand there is a lot of attention right now on predatory lending, and a lender that is not paying its closing agents is asking for trouble. If the DA does not help you the Maine Attorney General's office, Department of Financial Regulation should also know about this lender and your story. This may impact this lender's license and ability to conduct business in Maine. Good luck
