Legal Question in Intellectual Property in Maine

Photographic Copyrights

I am considering hiring a student photographer to take

some pictures for me. I am paying for the film and her

time and the processing of the film. She is buying the

film that she wants, but she is charging me a

reimbursement fee for the film. She has outright told

me that I would have to pay for the film. Who owns the

film and who owns the pictures. I have already agreed

that any reproduction will give her credit for the

photography.

You need to put in writing that the photographer is assigning to you all copyright in the photographs, and that you own both the prints and the negatives.

This is completely up to the two of you.

If you buy the film, then what she is really providing you is a service, not a product. She is converting blank film to film with images on it: you should own complete control over that product.

Get it in writing.
