Legal Question in Legal Malpractice in Maine

How do I get this fixed?

I need to know how to procede,

A Maine court judge violated the Maine statues, UCCJA and PKKA.

He took jurisdiaction over my child custody case even thought my daughter has resided in Mass with me for 10 months and had resided in Mass for over 6 months prior to the mother filing in Maine.

The law is clear and straightforward and he did not follow it. It is clearly legal Malpractice.

I need to know how to get it overturned. How do you get a Judge who was on a power trip to see he was wrong and has indangered a child?

It sounds like you have had a rough ordeal. I think your best option may be to do an appeal of the judge's order, assuming your appeal is timely. Consult a family law attorney, of which I am not one. Judges have a lot of discretion in their decision making, and this also allows them a certain degree of immunity, since they are acting as agents of the government. The Maine Tort Claims Act limits you to sending a notice of claim within 6 months of the accrual date of your cause of action, and 2 years to file suit. I would not handle the type of suit you wish to bring. Good luck, and thank you for your inquiry.
