If there is an actual condemnation notice posted on the property and the landlord hasn’t taken steps to remedy the issues that led to the notice by the first of the month, then I think you have a very strong argument that the rent and security deposit should be returned. Maine landlord/tenant law focuses upon the concept of “habitability”: If the property is “habitable” (has heat, running water and is generally safe for occupation) then your obligations under the lease continue. I suggest that you contact the City to learn the origins of the condemnation notice (assuming, again, that one is posted). You should also contact the landlord to glean the landlord’s position on the situation and what the landlord intends to do to fix this.
