Legal Question in Wills and Trusts in Maine

probate, wills

What is considered tangible property? Are house contents? My husbands parents died and his older brother is the pr, but refuses to give any info out. They had a lot of ''stuff'' and the will states tangibles to go to the 4 boys, but they are giving it away, not to those mentioned in the will. His brother's family is making out great with work from the estate and have been on a buying spree, but refuse to send bank statements. Any help would be great. Our lawyer doesn't seem to help. Will we have a chance to require a record of all monies spent and received?

Re: probate, wills

It depends on what the will says, but if the tangible property was suppose to be divided among the children, the it should be done evenly.

Tangible property is all the "stuff" the parents had. There are different ways of doing it, but if there is a dispute the personal representative should make a list of all the property that has value (even if just sentimental value) in the house. Once there is a list, then the sons can divide the property evenly.

And yes, you can get a record of how all the assets were distributed. You can also petition the court to have the PR removed if he is not acting properly.
