payment of a loan

a friend borrowed $50,000 from me and most of the transactions/agreements were via internet and wire service because he was in the service. he made 5 payments but has not made a payment since 5/06. i have all the emails and wire transfers. do i have a case?

It sounds as if you will be able to prove that a loan agreement was made. So, you should be able to enforce it in court.

Because the amount is substantial, you will probably not want to try to go to court on this without legal counsel. It will have to be filed in the circuit court where the rules are technical and strict.

Sure. Its a breach of contract case. The agreement and the receipts from payment or wire transfers are your evidence. Send him a certified mail letter (keep a copy) and demand the balance or let him know he is in breach of the agreement. This is due process under the law - give him the opportunity to correct the problem. If he now says "no I am not paying the balance," its time to sue. We practice in MD, D.C.
