Legal Question in Disability Law in Maryland

HI

Have a client who owns her house with her brother. He is an alcoholic and drink himself to oblivion as soon as he wakes up til he falls some place in the house totally drunk. When he does not have any more alcohol, he calls a cab to go to the liquor store. He had 2 DUI. She wants to sell the house and move. He refuses to sign the paperwork.

Is her best bet to declare him incompetent?

And if so, how should she goes about it?

She lives in Silver Spring, Maryland

You may want to consider a partition action where the court appoints a trustee to sell the house.

You did not indicate how the title was held.
