Legal Question in Bankruptcy in Maryland

Bankruptcy claim involved in a divorce

While married, I was an authorized user on a credit card. In April 2004, I filed bankruptcy and claimed this card. My husband allowed me to continue to use this card after filing. Now, I am involved in a divorce and he is contesting the divorce based on martial debt and wants me to pay for this card. What legal rights do I have? Will I be responsible for repaying this debt? Can I avoid paying this debt?

Your assistance is greatly appreciated.

Thank you.

Re: Bankruptcy claim involved in a divorce

Your charges to the card post-filing for bankruptcy are not discharged, either as to the bank coming after you, or as to your husband seeking an order in the divorce requiring you to pay them. Charges incurred pre-bankruptcy would be discharged.
