Legal Question in Bankruptcy in Maryland

Filing bankruptcy while going thru a Divorce.

I live in the state of Maryland and I am in the process of getting a divorce on grounds of adultry. I have bills that are requesting garnishments from only me & homes that my husband and I had that leases were broken. They are now suing us. These things are happening because of my husband commiting adultry and letting everything we had together go. Does it matter if we file bankruptcy together to get rid of the joint debt? Will this affect my divorce case? Also, will this affect my bankruptcy case becasue we are getting divorced?

Re: Filing bankruptcy while going thru a Divorce.

It may be the best way to deal with the situation to file bankruptcy together, before the divorce is final, but you each need to get independent legal advice about that, and your divorce lawyer should be involved in the discussion with bankruptcy counsel as it could affect the property settlement and possibly support and alimony issues. The case can be filed jointly, but that should be only after both spouses have had separate counsel advise them.
