Legal Question in Bankruptcy in Maryland

Lien

My husband and I filed bankruptcy in 1998. We recieved our discharge in 2000. We are currently in the process of selling our home and we have found that a deparment store has a lien on the home. This department store was listed in our bankruptcy. Is it possible for them to put a lien on our home after a bankruptcy has been discharged.

It would be unlikely that the store got a valid lien unless it obtained a judgment against you prior to the filing of your bankruptcy and established a lien at that time. You should consult an attorney to resolve the issue.

Re: Lien

If the lien pre-dated the bankruptcy, it is valid. If not, you should see your bankruptcy lawyer who should be able to get the creditor to release it.
