Ncd
My client signed the following:
“Each Party agrees not to directly or indirectly contact, deal with transact, or otherwise be involved with any corporation, partnership, proprietorships, trust, individuals, or other entities introduced by either Party without the specific written permission of the introducing Party. e specific written permission of the introducing Party. “
But only this clause was on a new customer form we created, not a full NCD.
He is now going direct to my supplier, can I sue him? or block him?
Re: Ncd
I think you would have a difficult time enforcing this, especially since he didn't specifically agree to it. Your supplier and you ought to have an agreement or understanding that he doesn't sell to your customers, much like a wholesaler, if that's possible, but if it's not, I don't see how you can keep the two from transacting business with one another.
