Oder to appear in attorney's office for examination in connection with judgement
I am an officer of corporation and have been ordered to appear in plaintiff's counsel office for examination under oath? Company is out of business and I can't hire an attorney. I have been served today for tomorrow examination
Re: Oder to appear in attorney's office for examination in connection with judgement
If the corporation is a defendant in a lawsuit, the plaintiff has a right to take the deposition of a corporate officer. You can advise the attorney before the deposition that the corporation is now out of business, but if he/she chooses to proceed with the deposition, you will have to answer the questions put to you at the deposition. You don't necessarily need an attorney, although you are entitled to have legal representation.
