Legal Question in Business Law in Maryland

Oral Contracts Regarding Pets

A party advertises that it can no longer take care of a pet and wishes to give the pet away. A second party accepts the pet and gives the first party $20 in cash, although it is not required. Later that day, the first party calls the second party and requests the return of the pet. Is the second party legally required to return the pet?

Re: Oral Contracts Regarding Pets

No, unless there was fraud. It's either a completed sale or a completed gift. If there was fraud (for example, recipient says "I live on a wonderful farm where Rover can play with the other dogs and chase the chickens" but really lives in a cramped, dingy apartment in the city), the gift or sale could be undone if the giver/seller relied on the false statement.
