yellow page ads

A phone company dropped my yellow page ad without reason or notification. She had contacted my company to upgrade the ad in Sept.05 for a deadline in Oct.05. We faxed ad styles, pricing, but I did not meet the deadline. Forgot about it, would upgrade nest year. Realized something was wrong when I wasn't fielding the calls I once had. Contacted them, they verified the upgrade try, but couldn't find why my ad was canceled. Was paid up to date, did not know why. My company lost hundreds of thousands of dollars on this blunder. Can I sue for lost revenue, diress? This is not right, Its like my compnay is starting over, they were the only yellow pages we advertised in!!!

Your fact pattern is confusing. On the one hand, you acknowledge that you missed the Oct. '05 deadline, but then say the phone company forgot to publish your ad. Perhaps you are referring to the following year. If that's the case, and you can clearly establish that you had timely provided them with everything they needed to publish in the next directory, you might have a successful claim. However, the difficulty in these cases is proving that your revenue loss is directly attributable to the failure to publish. If you can establish a long track record of previous revenue and then a sudden drop off that cannot be linked to any other source, you may be able to prevail.
