probation violation?

As part of a plea bargain for a traffic

misdemeanor, i agreed to 2 years of

probation before judgement,

featuring monthly urinalysis.

After a year of sobriety ( Jan. '08) ,

my attorney filed a modification for

unsupervised probation for the

remaining year. It was then revealed

by my P.O. that I tested positive in

Dec. 07 for PCP!

I do not use, would not use, and

would avoid like the plague anyone

who did use PCP. I probably haven't

even heard it in conversation since

1989.

I had the Flu in Nov. 07 and was

treating it ''over the counter'' i.e.

anti-histamines, Robitussin and

Ibuprophen. Also to be considered is

lax security at the probation office.

Am I the victim of a false reading or

sample tampering?

Do I have any options , 2 months

later, of proving my innocence?

Did you ask these questions to your attorney? If not, you should do so. If you are unhappy with his/her representation, you should find a criminal attorney who you can ask questions about your case.
