purchase of damaged new vehicle

I purchased a new vehicle that shut down while I was driving it. It hd

to be towed in. The dealership's service department determined that

it had a damaged gas tank. This damage did not occur while I was

driving it. They say it did and that I have to go through with the

purchase. What recourse do I have?

This largely depends upon the contract of sale and any warranty that was provided. In a case such as this it may be beneficial to have an independent mechanic of your choice inspect the vehicle to discern the source of the problem.

The status of the dealer based upon how it is held out to the public may come into play. Sales representations may be "puffery" but may also be binding.

Often these matters are addressed through an agreement. If the dealer is stonewalling an agreement it may be to your benefit to contact an attorney.
