Legal Question in Credit and Debt Law in Maryland

Can I collect post judgement interest of $15,000 if it was ordered but not paid? The judge , upon request of the debtor, issued a court order satisfying debt paid. What should I do? The debtor is taking me to court for over pymt of principle and unjust enrichment. Should i request the judge for a court order of interest due me? Please advise. TRISH.

In this state, post judgment interest accrues at the rate of 10% on whatever portion of the judgment that remains outstanding. The judgment creditor has an obligation to keep track of payments made and if there is any type of wage garnishment must file regular reports. If/when the judgment satisfied that usually ends the matter and the judgment creditor cannot continue to collect or demand payment for a satisfied judgment.

(In the ordinary course a judge does not need to step in to say when a judgment is satisfied - instead, the judgment creditor issues a certificate of satisfaction when everything is paid. However once the court rules on a particular issue that decision usually stands unless it is changed on appeal or other review. It is not clear from your post whether the defendant vacated the judgment, in which case it no longer exists, or whether s/he filed some post-judgment motion to modify.)
