Legal Question in Credit and Debt Law in Maryland

Delay Court Date

I have a law suite against me, scheduled for trial on Wednesday. I just recently found out about the suite, because the papers were served to my old house not my school address or my new house. Can I take any action at this point to have the trial delayed. Also, does the fact that I was not given the summons directly, but rather they were given to a relative at their address (they moved into our old house) provide me with any legal action?

Re: Delay Court Date

It sounds like you were technically not served, but the Court probably thinks you were. If you do nothing, judgment will be entered against you. If this is Maryland District Court, if you show up the trial date will automatically be continued (delayed) if you have NOT filed a notice of intention to defend, so that is probably your best approach, or it would seem that way at least with the limited information available here. By the way, unless the case is too small to make a lawyer worthwhile, even if you do not really dispute this matter it is probably best to consult with a lawyer to get advice on defending the case and, if there is a defense, to have the lawyer represent you in defending or trying to settle the matter.
