Legal Question in Credit and Debt Law in Maryland

Inquiries

In the fair credit reporting act, or any other legislation, is there any protection for Maryland residents regarding inquiries placed from Credit agencies when no oral or written permission was given to pull a credit report? These inquiries negatively impact your credit score.

Re: Inquiries

It is a violation of the Fair Credit Report to pull someone's credit report without permission (impermissible access). The credit reporting agency may not be wrong to report the fact that it was pulled, since it was pulled by someone, but the party responsible for pulling the report could be liable for damages and attorney fees. They have invaded your privacy and obtained access to your personal information illegally. Note that credit card and other companies routinely look at (pull) credit reports during a process called pre-screening, which is allowable as an exception in the FCRA. Please give me a call to discuss this further if you like. - Michael Worsham
