what is the punishment for a 12 year old who sexually abuse a five year old child? and is it true if he gets a criminal record it will be expunged by the time he turns 18years old?

If found involved in the offense or "facts sustained," the juvenile court would probably enter a delinquency finding and commit the child to the Department of Juvenile Services for treatment. A commitment lasts three years, but may be extended until the child is 21.

Juvenile court is not criminal court. Juvenile records are sealed and not public.

Criminal matters involve adults or children whose cases the juvenile court has waived jurisdiction to the criminal court. Criminal convictions may not be expunged.

I need to know the details of the alleged act to discern whether expungement applies, as well as the opinion of the judge. Although juvenile records are sealed the records themselves do not "go away."

Remedial action should be taken to ensure that the acts do not continue. Counseling may be available if you do not have an ability to pay and sometimes working with the Court can bring about this result.
