Max 3 years in prison + $500 fine or both. If arrested on the spot after the police are called, you will see a commissioner who will decide on bail. You could also be charged after the filing of an Application for Statement of Charges via a summons instead of being arrested on the spot or having a warrant issued. If a warrant is issued and you are arrested on the warrant, you will also see a commissioner.

The only wise thing to do is to get a lawyer to try to avoid being arrested, because we can often quash warrants.

Bail is not automatically required. Instead, either a court commissioner or a judge has to discretion to require it, considering the risk that the defendant might fail to appear and whether the defendant poses a risk to public safety, including himself or herself. An attorney can assist you with evaluating the states case, any defenses that you might have, and any plea offer that might be made, so that you can decide whether to plea bargain or go to trial. If you were to be found guilty, then an attorney can assist you with presenting mitigation, allocution, and a recommendation for a more lenient sentence. Consider seeking a confidential consultation with an experienced criminal defense attorney. Beware that online posts are not confidential. If somehow the prosecution were to find your post, then it might be used in evidence against you.
