Ultimately, release would probably depend on a bail review in the state where the criminal case is pending. However, a person has a right to an extradition hearing in the state where he or she is. While bail might be set by a court in the state where the person is, that is unlikely. Most detain the person for the state which is seeking extradition.

The seriousness of the charge and the person's prior failures to appear affect the bail decision.
