Can I be charged?
If I was drunk and the person driving my car was not but only had a learners permit could I be charged with drunk driving?

Although the police can charge anyone with anything, It does not appear from the caselaw that you can be convicted of drunk driving when you are a passenger in a car where the driver is using a learning permit.
