Legal Question in DUI Law in Maryland

DUI/DWI case postponed

My 19 yr old daughter was arrested for DUI and underage drinking in April 05.She was in allegany co and blew .12. Her hearing was set for 11/18/05, in district court.We received a notice that the hearing was postponed. My understanding is there is a backlog of cases because there is only one judge on the bench, as of now.Hearing has been rescheduled in Feb.06. Does this work in our favor due to the right of a speedy trial?

The speedy trial provision of District Court would not even be considered until at least a year after the event. Even then, you would have to show you were harmed in some way. For an example, a witness died. You more immediate concern is your daughter is facing the lose of her driving privilege for drunk driving. You should be consulting with a criminal trial lawyer, like myself, on how to prevent this from happening.
