You need to consult with an experienced family law attorney who can assist you in filing a motion for custody on the part of your daughter. Right now either parent has a right to custody, so you need a court order. Your daughter's has a physical status in no way disqualifies her from obtaining custody. The court would look at what is in the best interest of your daughter, and with your support and the various failings you described on the part of the father, she probably has an excellent chance of prevailing in court. At the same time the father will be ordered to pay child support, although his unemployment could be a problem there.
