Legal Question in Family Law in Maryland

my 16 year old son wants to come and spend his last 2 years of high school with me I am his mother and his father has custody. what can I do he calls and cries to me all the time and I want him to come but his father wont budge. Maryland has jurisdiction over this matter. We were never married and he has been with his father since he was 2

Generally once a child reaches 16 a court will honor his wishes regarding custody. So if the father won't cooperate, you can file a petition to modify custody in the county where they live or the county where the existing custody order sits. Unfortunately you won't be able to get this done before the beginning of the forthcoming school year, but perhaps in time for the spring semester.
