Legal Question in Family Law in Maryland

child custody

My ex brother in law gave up rights to his daughter to whom he never saw. He does pay $385.00 a month for her per court. He says that if the mother dies he will take the ''thing'' (his daughter) to live in foster care. We all live in maryland . Can he do that?

Re: child custody

If the father has given up his parental rights through a court action he can't assert any right to custody or to deciding who should have custody. If a suitable family member asks the court for custody, the court would award custody to that family member rather than put the child in foster care.
