Child support arrears

my wife just adopted my son and the NCP owes several thousand dollars in arrears still. There is a money judgment for the money she owes but not a set amount to pay monthly. the ncp has agreed to make payments in amount of $300 until judgment is satisfied. 1st do I need to file motion to terminate current support and then file a consent order ordering ncp to pay the $300 per month until satisfied? Any advise is greatly appreciated

I suggest you put the monthly payment agreement in writing, to be signed by the ncp and you. I suggest you add a clause that says if she breaches the agreement (misses a payment), she's liable for your legal fees incurred in enforcement. If she breaches the agreement, you can try and collect the balance due on the judgment through wage or bank account attachment.

As for the termination of support, it's really up to her to do that, but since you're not going to be looking for support post-adoption, probably nothing will happen.
