Legal Question in Family Law in Maryland

I currently have a child support order and went to modify it last Dec after I found out my exhusband was activated in the military, and sent to Kuwait. The hearing was stayed until Sept of 2011, when he is supposed to return.

I don't know if it's true but I found out he may stay another year over there.

My daughter will be 18 then before he comes back. Can I still take him back to court for the modification? His income increased substantially after being activated!

And can I just contact his unit to see if he indeed is going to have his orders extended?

The court has authority to modify the amount of support effective with the date you filed your petition, so the delay caused by your ex's military assignment should not work to your detriment. As for contacting his unit, I doubt that they will give out this kind of information. Since you have a hearing date in September, it would be up to him to try and postpone it due to a change in military assignment.
