Legal Question in Family Law in Maryland

Custodial Parent in NC Continues to Get Over Paid By State of MD CSES

The Custodial Parent gets Support via court order and it is deducted from my check weekly. She moved my daughter to NC 11 years ago from MD knowing it would be impossible for me to see her every weekend as custody agreement granted me. Shouldn't I get to pay less since it was her choice to leave and cut me out?

Also, MD State CSES continues to over pay her. I have the documentation from their own payment system that proves it. I have asked for an audit, presented my supporting documention and every week they continue to over pay her and ignore me reporting it and my written request for an audit. They also have done nothing to obtain monies my past employer with held from my checks based on their court order and I've provided documentation to prove that his deductions from my checks are far more than the payments he made over the course of my 4 years of employment.

Since this is the State, do I have any legal recourse or is it true that you can not fight the government? I am so frustrated and at a loss over this I just do not know what to do or who to ask anymore. I thought I was doing the right thing by reporting the defrauding of their system because the mother never will report it, but evidently not... Thanks

Re: Custodial Parent in NC Continues to Get Over Paid By State of MD CSES

Regarding your first question child support does not change due to your lack of visitation. You can file for a modification of the custody order and try to obtain additional time to make up for the fact that you cannot get your regular visitation you had when your child was in the area. Typically in such situations more time is given during the summer and the child's time off from school to make up for not having the regular contact you once did when the child was in the area. Additionally, you can request that the cost of transporting the child back and forth be divided between the two of you or depending on the other parties financial circumstance ask that the other party pay the cost of transporting the child entirely. Regarding the error in the amount taken from your check if the child support enforcement office does not correct the error you may need to file something with the court in order to get them to do so. Once the court gets invovled it will likley be resolved. If you need additional information please feel free to contact me at [email protected]
