Legal Question in Family Law in Maryland

Custody of children

My boyfriend and I are on the rocks. If we seperate I would move back home to Florida. How would that effect our 6 month old son? How does custody between states differ since my boyfriend will be staying in maryland?

Re: Custody of children

Since there is no custody order in place now, you are free to live anywhere you want. Once you have established residency in FL after 6 months, you can file a court petition for custody and child support there. You would have to serve the court papers on your ex, but he would then have to come down to FL if he wants to contest the case.

All states are similar in how they determine custody issues. Essentially, the paramount concern is the best interests of the child.
