If my daughter was to enter a long term rehab for drug abuse and does not give me at least joint custody for medical purposes can she be charged with child neglect?

Not necessarily. The issue is whether she's able to competently care for her child notwithstanding the drug abuse issue. If you see evidence of neglect, you can ask your county's child social services department to investigate.
