Can i get my divorce if i move out of our house.And will i be intiled to my part of the properties? He retired a few years ago. And now works a second full time job. I work in a nursing home.I have been working in nursing homes for nearly 21 years now and was looking forword to working less not more at my age. I just want to know what i should now?

You can obtain a divorce. Marital property will be divided as well as marital debt. Retirement payments can be obtained through a qualified domestic relations order. Contact me to discuss.

If you move out by agreement with your husband, you will be eligible for a divorce in 1 year. If you move out without an agreement, it's a 2 year wait. Either way, you will be entitled to your share of marital property--generally, property acquired by either of you during the marriage.
