Legal Question in Family Law in Maryland

divorce rights for woman

Pre-marriage I've been with my husband for 5 years, and been married for about 2 years for a total of 7 years. During our entire relationship, if we use my money now, he state that we will rely on his money which is kept in secret funds such as Swiss accounts for retirement. Since we are married, will I be able to have a portion of any of his money in case of a divorce? How much right do I have monetary wise if we get a divorce? What if he has his money in the name of others to hide his funds?

Re: divorce rights for woman

Under MD law, any property acquired during the marriage, such as either spouse's earnings, or items purchased with marital funds, are marital in nature. In a divorce, you would be entitled to share in this property. Any property owned by either party before the marriage, or property acquired during the marriage as a result of a gift to one of the parties, or inherited by one of the parties, remains that party's property. And if your husband uses money he had before the marriage and buys something with it during the marriage, that remains his, unless the evidence shows he intended that you be a joint owner of that property. Even though you were together for 5 years before the marriage, none of that time has any legal significance in terms of determining your right to share in your husband's property.
