Legal Question in Family Law in Maryland

"Eighteen"

I pay child support for two sons. However one just turned eighteen this month. Our parenting plan and divorce agreement have no other written agreements concerning support of any kind after they turn eighteen.(Of course I intend to continue to help in any way I can.) I want to know if my next child support payment can automatically be written for the remaining son, in other words, half.

The wording of your agreement regarding child support is very important in answering your question. If it spells out an individual amount per child, then you can cease paying the amount assigned to the emancipated child (i.e., the one who just turned 18). More likely, it sets out an amount covering both children. In this case, you should recompute the amount from the Maryland Child Support Guidelines for 1 child and try to get your ex- to agree to an adjustment of the payment to that amount. Otherwise, you will have to file a court petition to modify the child support amount to the proper amount.
