Legal Question in Family Law in Maryland

What to expect for child support when combined income exceeds 10K oer month

My ex has come after me for additional child support. in this case our combined income is close to 200K. I have a higher income with abo;ut 59% of the combined income. We have a marital agreement that says we will use the formula provided by the guidelines. Since we are above the $10K combined monthly income, my ex wants to use a calulation based on expenses. I want to exptrapolate using the formula as our agreement calls for. I understand that the award is up to the judge's discretion. What can I expect? Is extrapolation common? The case is Baltimore County.

We have had number of cases similar to yours recently. It is fairly common for the custodial spouse to file for modification of child support. But there has to be some pretty substantial changes in the original circumstances. I take it the Court ratified the original amount ordered to be paid at the last hearing. I also assume your divorce is now final and you have been paying according to the order. At the upcoming hearing on modification, the judge most likely will take testimony and evidence and probably apply the Maryland guidelines. You may be well advised to run those numbers thru the system beforehand yourself. Most law offices doing domestic cases have the programs. This way you know going in what to expect. The last time we were in Court with a similar case, we were off by $1 dollar between our calcualtions and the Judge's finding. Good Luck to you. Call if you need assistance.
