I have Sole Legal and Physical custody of my son. The father has visitation rights. The father's girlfriend asked for my insurance information to take my son to the doctors. I told her No, I would take him. She took him anyway and billed my insurance company and also Forged my signature. What can I do about this?? Anything??

Re: Forgery

Mr. Sher is correct. You should notify all health care providers. In addition, I would provide all health care providers, daycare providers, school administration etc. with a certified/true test copy of any court order that grants you sole custody of your child.

Forgery is a serious criminal matter. I cannot advise you as to whether you should consult with a Commissioner to proceed with possible criminal charges. You should also consult with your insurance company/security or fraud division regarding the unauthorized signature.

Re: Forgery

First of all, you should immediately notify the doctor involved in this and any other health care providers what occurred. As the sole custodian, only you can make health care decisions for your child, unless there is an emergency during visitation and you can't be contacted by the father.

If possible, you ought to discuss this with your ex, and try to work out an arrangement so that this doesn't happen again. After all, it's your child's health that is potentially at stake here.
