Legal Question in Family Law in Maryland

My ex husband passed away and was the custodial parent for my 17 and 13 yr old daughters. Do I need to file something with the court to have legal custody of them or is that something that is automatic in Maryland?

You need to file a petition for modification of custody, but in the interim you can certainly assume de facto custody.
