Legal Question in Family Law in Maryland

My husband and I have been seperated about 2 years. Child support order is in effect. He has unreported income that he receives annually. So far, its about 150,000.00. Is my son intitled to any of this even though he has not reported it.

Yes. The problem is being able to document this in a court hearing, so a judge would have a basis for applying it to the formula for determining the amount of child support that a parent must pay. The definition of income is very broad in determining child support obligations. If there is some record of it (his books, bank account, etc.,) you could subpoena those records.

You should contact me to begin an appropriate investigation and to acquire jurisdiction to require that third parties provide the documentation necessary to acquire an order. Your case may involve an upward modification of child support and you should not delay as any such modification will be effective only from the date of filing (that is, no retroactive adjustment.) Call me to discuss your legal needs.
