Jurisdiction

My wife took off with my minor child 2 1/2 yrs ago to Texas. I am in Maryland and I want to file divorce now, which state will carry jurisdiction?

You can file in MD as a resident here if you have lived here for a year, or in TX since your wife is a resident there. If you wish to contest custody, you would have to do so in TX. If your wife wants to raise child support or alimony issues, she could do so wherever you file, but obviously it would be to your advantage to file in your home state.

You can file for divorce in Maryland since you are a resident here. You can ask in your divorce petition that custody or visitation be addressed.
