Can I move out of state ?

I have 2 children, no legal custody papers as of yet, I can not afford to live in this state anymore. I have a home and support given to me if I move, can I do this ? My ex and I are in the begining stages of custody/visitation procedings, but nothing has happened yet. Can I leave ? The children have been with me since the second they were born. The father and I have been apart for 8 years and I am now married. And no, the father and I were never married. The children have been with me, go to school where I live, the dr's. I chose, and so on. I need help as far as information on what I can do.

There's nothing legally stopping you from moving at this time. If your ex objects, he'd have to file a petition for custody or visitation and ask the court to limit you to this area. I suggest you dialogue with the ex, explain the situation, and offer to work out a visitation schedule if he wants it. You should try to get him to enter into a written custody/support agreement with a visitation guarantee so you don't have to fight over this in court.
