If you want to have the child returned to you in a custodial relationship you would have to file a petition for guardianship. This is something that should have been done once you assumed responsibility for his care during his infancy. You will have to serve the papers on the grandmother and probably get a court order requiring her to produce the child. You should engage an experienced family attorney to help you with this.

You may want to consider contacting the Department of Social Services to discuss the matter especially where you believe the child may be emotionally or otherwise neglected.
