If I build a house while I'm separated from my husband before the divorce is final, will he be entitled to the house?

Re: separation

Under the law, property acquired with marital funds is marital in nature and therefore subject to equitable distribution in the divorce. Since earned income is marital, if that is what you are using to build the house, he might make a claim. The solution if possible is to try and enter into a separation agreement in which each party waives an interest in the other's post-separation assets. An experienced family attorney can assist you with this.
