Legal Question in Family Law in Maryland

Sole physical custody

I have ''sole physical custody'' of my three children.

I also agreed to shared legal custody.

Can I decide if my children can go away with my ex for more than the agreed one night per week?

Re: Sole physical custody

If you have sole physical custody and joint legal custody, you do not have to agree to more visitation than that which was ordered by the court, but you can if you wish. If your children want to see the other parent more often, or if there is a special occasion for which your ex wants extra visitation, it may be a wise decision to agree, but unless your ex goes back to court and gets a modification of the original order, you have the right to refuse.

You can always agree to let the father have visitation beyond what is set forth in an existing agreement or court order, but you are not required to do so. If you can't agree, the father has the option of seeking an enlargement of his visitation rights through the court.
